Draftmic Terms of Service and License

Please read these Terms of Service ("Terms") carefully before using the Draftmic desktop application (the "Software") operated by Draftmic ("us", "we", or "our").

By downloading, installing, or using the Software, you agree to be bound by these Terms.

1. Free and Open Source License

Draftmic is free and open-source software. The source code for the Draftmic application wrapper and user interface is licensed under the GNU Affero General Public License v3.0 (AGPL-3.0). You are free to download, use, modify, and distribute the Software in accordance with the terms of that open-source license. The complete source code is available on our GitHub Repository.

2. Artificial Intelligence and Output Disclaimer

Draftmic utilizes advanced local Artificial Intelligence (AI) models to transcribe audio, improve grammar ("Magic Improver"), and translate languages.

You acknowledge and agree that:

• AI Limitations: AI models are not infallible. They may hallucinate, make translation errors, drop words, or alter the meaning of your original dictation.
• User Responsibility: You are solely responsible for reviewing, verifying, and editing the output generated by the Software before using it, publishing it, or sending it to third parties.
• No Liability for Content: We are strictly providing the tool. We accept zero liability for any miscommunications, grammatical errors, offensive text, or any damages (direct, indirect, or reputational) resulting from your reliance on or use of the text generated by the Software.

3. Third-Party Services and Open Source Dependencies

Draftmic operates offline, but it utilizes standard HTTPS network requests to connect directly to huggingface.co when you choose to download or update the AI model weights required for the Software to function. By initiating these downloads, you agree to comply with the acceptable use policies of Hugging Face and the respective model creators.

Furthermore, the Software bundles and downloads various open-source AI models and libraries. Your use of these specific models is governed by their respective licenses. We do not own these models, and we provide them solely as an interface. You must comply with their licenses:

• Whisper (by OpenAI): The Whisper model architecture and weights are licensed under the MIT License. The C++ port (`whisper.cpp`) by Georgi Gerganov is also licensed under the MIT License.
• Llama 3.1 & 3.2 (by Meta): Llama models are licensed under the Meta Llama 3 Community License. By downloading and using Llama models, you agree to the terms of the Acceptable Use Policy provided by Meta.
• Qwen 2.5 (by Alibaba Cloud): Qwen models are licensed under the Apache 2.0 License or the specific Qwen Research License depending on the exact parameter size downloaded.
• Mistral (by Mistral AI): Mistral models are licensed under the Apache 2.0 License.

By using Draftmic, you acknowledge these attributions and agree to adhere to any use-case restrictions outlined in the licenses of the underlying models you choose to download.

4. Privacy

Your privacy is fundamentally protected by the offline architecture of the Software. Please review our Privacy Policy, which explains that your audio and text are processed locally and never uploaded to our servers.

5. Disclaimer of Warranties

The software is provided "as is", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and noninfringement.

We do not warrant that:

• The Software will function uninterrupted, secure, or available at any particular time or location.
• Any errors or defects will be corrected.
• The transcription or translation accuracy will meet your specific requirements.

6. Limitation of Liability

In no event shall the authors or copyright holders be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with the software or the use or other dealings in the software.
